Terms and Conditions

1. The service

Brisily sells prepaid eSIM data plans for the destinations listed at the time of purchase. Connectivity is provided over the networks of local mobile operators through our wholesale connectivity provider; Brisily is not a mobile network operator.

An eSIM is delivered digitally: after payment you receive an order page link and email with a QR code and manual activation details. No physical product is shipped.

2. Eligibility and device compatibility

You are responsible for confirming that your device is eSIM-compatible and carrier-unlocked BEFORE purchasing. Compatibility information shown on our site is indicative; device manufacturers and carriers may restrict eSIM use.

3. Ordering and delivery

Orders are confirmed once payment is captured. Delivery is by email and via your personal order page, normally within minutes of payment.

If fulfilment fails, we will retry and keep you informed; if we cannot deliver your eSIM, you receive a full refund.

4. Prices and payment

Prices are shown at checkout in the displayed currency and include applicable VAT unless stated otherwise at checkout.

Payments are processed by Stripe. Brisily does not store your full card details.

5. Plan validity and usage

Plan validity starts when the eSIM first connects to a supported network at the destination, and runs for the number of days stated on the plan.

Plans are data-only unless stated otherwise, subject to fair use and to the coverage, speed and availability of the underlying local networks — which we do not control.

Top-ups purchased for an existing eSIM extend or add data under the same conditions.

6. Right of withdrawal and refunds

By ordering, you expressly request immediate performance of a digital service. Under EU consumer law (Directive 2011/83/EU), once the eSIM has been delivered and/or activated, the statutory 14-day right of withdrawal no longer applies to the extent the service has been performed.

We refund in full: orders we fail to deliver, and eSIMs that cannot be installed on a compatible, unlocked device despite reasonable troubleshooting with our support.

We do not refund: plans already partly or fully consumed, incompatibility with a locked or non-eSIM device that you could have checked before purchase, or local network conditions.

7. Purchases through travel-agency partners

Brisily powers branded storefronts operated under the name of travel-agency partners. Unless the storefront states otherwise, Brisily is the seller of record and these Terms apply; the partner provides first-line customer care under its own brand.

8. Acceptable use

• No unlawful use, spam, or network abuse.
• No resale of individual consumer plans outside an authorised partner agreement.
• We may suspend an eSIM in case of fraud or abuse, in line with the underlying operator policies.

9. Liability

Nothing in these Terms limits liability that cannot be limited by law. Otherwise, our aggregate liability per order is limited to the amount paid for that order. We are not liable for indirect losses (missed connections, lost profits) or for outages of local operator networks.

10. Complaints, governing law and disputes

These Terms are governed by the laws of Spain; mandatory consumer protections of your country of residence remain unaffected. EU consumers may also use the European Commission ODR platform (ec.europa.eu/consumers/odr).

11. Changes

We may update these Terms for future purchases; the version accepted at checkout applies to your order.
